David N. Hilton

Attorney

David N. Hilton has a multi-faceted practice assisting clients throughout North Carolina. His practice areas include business and corporate law, commercial transactions, construction law, commercial and residential real estate, wills & trusts, and estate planning and administration. David is admitted to practice before the United States Court Of Appeals and the United States District Court, Eastern District of North Carolina.

Background.

David is a North Carolina native and grew up in the triangle area. David attended Appalachian State University where he graduated cum laude and obtained a Bachelor of Science degree in Political Science, concentrating in Town, City & County Government, with a minor in Planning and Zoning. While at Appalachian State, David was a member of Gamma Beta Phi Honor Society, Pi Gamma Mu, ASU Inter Fraternity Counsel, the Order of Omega, and the Delta Chi Fraternity where he served as president of his chapter and received the Delta Chi Fraternity National Merit Award.

After college, David attended Campbell University’s Norman Adrian Wiggins School of Law. His honors and awards at Campbell included: Campbell Law Review, Prince Evidence National Moot Court Team, School of Law Academic Scholarship, Order of the Kivette, Who’s Who Among American Law Students, and the Branch Banking & Trust Company Will Drafting and Estate Planning Award.

Hobbies/Interests

Practicing Brazilian Jiu-Jitsu as a Purple Belt, snow skiing, hiking and other outdoor activities, Y Guides, and enjoying playing basketball, pickleball and volleyball.

Representative Experience Includes.
  • Successfully represented a national landlord in a breach of lease lawsuit against a national tenant resulting in a $2,800,000 settlement and payment to the landlord.
  • Represented the owner in $54,000,000 commercial development which included HUD financing with Federal and State tax credits including, historic, NC Mill Credit and new markets.
  • Represented owner in the refinance of a shopping center for $10,000,000.
  • Negotiated and consummated loan modification to extend existing $9,500,000 loan for a retail shopping center owned by TICs.
  • Negotiated contract for sale of an out parcel to Bojangles.
  • Represented the buyer in the purchase and redevelopment of a historic warehouse for $20,638,000 which included two CDE loans with Bank of America, Federal and State historic tax credits.
  • Represented the buyer in the purchase of a retail center for $1,650,000.
  • Prosecuted a civil action against a tenant and obtained a judgment for $109,000.
  • Negotiated lease agreement with Harris Teeter on behalf of the owner of a retail shopping center.
  • Represented the lender in a $4,800,000 construction loan for a mixed use development
  • Created a multi-faceted condominium with boat slips and residential units

Scott P. Silvers

Attorney Profile

Scott P. Silvers assists clients in North Carolina protect and manage assets in the areas of commercial and residential real estate closings, business transactions, leases and civil litigation.  He also serves clients throughout the country practicing immigration law. 

Scott is a native of North Carolina.  After graduating from UNC Chapel Hill, he attended the University of North Carolina School of Law in Chapel Hill, where he obtained his Juris Doctor and graduated with honors.

While attending UNC law school, Scott was selected to be a member of the UNC Law School Faculty Selection Student Committee. 

Scott speaks both English and Korean. While living in Korea, Scott was required to speak Korean as the host of two different television shows. He was a host for Arirang TV’s “Destination: Korea,” a travel show. Scott was also the host/talent of a reality comedy series for SBS TV’s “Live Well, Eat Well”.

  • $3,300,000  construction loan closing to build commercial building on raw land.

Represented clients in a wide range of District and Superior Court civil cases and assisted in the collection process in connection with the resulting judgments.

  • Successfully secured over five million dollars of payments, through debt collection efforts and litigation, due and owing to clients.
  • Secured payment of over $100,000 in lawsuit regarding ownership of real estate.
  • Secured payment of over $120,000 in property damage dispute with contractor.
  • Successfully represented injured party in negotiating settlement of personal injury claims against a Fortune 100 Company.

  • Successfully secured National Interest Waivers (NIW) and green cards for post doctorate researchers from Duke University.

 

  • Successfully secured F1 student status for numerous clients changing status from B2, J1, etc.

 

  • Successfully secured E-2 visa and/or E2 extension of status for numerous clients.

 

  • Successfully secured E-2 investor status extensions for E2 Enterprises reporting less than $10,000.00 in annual net income.

 

  • Successfully petitioned for and secured the return of over $60,000.00 in funds for clients after their money was seized by the U.S. Customs and Border Protection.

 

  • Numerous family permanent resident card (a/k/a “green cards”) and citizenship applications, including filing for family members visiting on the visa waiver program.

Doug McClanahan

Doug McClanahan came to North Carolina from Florida in 1989 to attend Appalachian State University, followed by law school at Campbell University. He passed the Bar in 1995 and moved to Raleigh.

Between 1995 and 2001 he worked in 2 small firms. In 2001 he opened McClanahan Law Firm. After 20 years of solo practice, in September 2021 he joined Harris & Hilton. Upon Nelson Harris’ retirement in January 2022, the firm became Hilton, Silvers and McClanahan.

Doug’s practice areas include business and contract law, collections, construction law, and real property law. Doug’s professional experience includes litigation with an emphasis on contract disputes and construction cases as well as transactional services such as contract drafting, business formation and asset sales.

Doug is a member of the North Carolina Bar Association and the Wake County Bar Association. His NC Bar Association activities have included being a Division Director of the Young Lawyers Division, the Technology Chair of the Construction Section and Chairperson of Lawyers in the Schools. He is currently a member of the Litigation section. He is currently on the. His volunteer activities have included Lunch with a Lawyer, Job Shadow, Mentoring (Campbell Law School), and Wake County Bar Association Public Service Committee. 

Julie O’Day

Background.

Originally from Michigan, Julie and is currently a resident of Wake Forest, North Carolina. Julie graduated from Michigan State University in 1987 with a B.A. in Communication Arts & Sciences and from the University of Dayton School of Law where she obtained her Juris Doctorate.

Julie has practiced in the areas of residential and commercial closings for over eight years and assisted both buyers and sellers with standard mortgage loan closings, cash closings, Small Business Administration financing, construction to permanent financing, and 1031 Exchanges and seller financed closings. Additionally, Julie has worked with investors to negotiate pre-foreclosure sales and has negotiated short sales for distressed buyers, and assisted both buyers and sellers in “FSBO” closings. With this knowledge, Julie is personally committed to making the closing go smoothly for everyone involved in the transaction.

In the community, Julie is actively involved with PTA and with her children’s sports.
